Welcome to Ailand. In these Terms of Service, the terms “we,” “us,” and “our” refer to Ailand.

Ailand operates this store and website, including all related information, content, features, tools, products, and order-related services, to provide you, our customer, with a carefully selected shopping experience (the “Services”). Ailand is powered by Shopify, which enables us to provide the Services to you.

The following Terms of Service, together with the policies referenced herein, describe your rights and responsibilities when using the Services. These Terms of Service may also be referred to as the “Terms.”

These Terms of Service contain important information about your legal rights, including provisions regarding disclaimers of warranties and limitations of liability. Please read them carefully.

By accessing, visiting, or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you must not access or use our Services.

Section 1 - Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in the prefecture, state, or region where you reside. You also consent to allowing any minor dependents to use the Services on devices that you own, purchase, or control.

To use the Services, including accessing or browsing our online store or purchasing products or services offered by us, you may be required to provide certain information, including your email address, billing information, payment information, and shipping information.

You represent and warrant that all information you provide to our store is accurate, current, and complete, and that you have all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 - Our Products

We make every effort to accurately represent the products and services available through our online store. However, colors and the appearance of products may differ from what is displayed on your screen depending on the type of device you use to access the store and your device settings.

We do not warrant that the appearance or quality of any products or services you purchase will meet your expectations or be the same as depicted or presented on our online store.

All descriptions of products are subject to change at any time without notice, at our sole discretion.

We reserve the right to discontinue any product at any time. We may also limit the quantities of products that we offer on a case-by-case basis to any person, geographic region, or jurisdiction.

Section 3 - Orders

When you place an order, you are making an offer to purchase. Ailand reserves the right to accept or reject your order at its sole discretion for any reason.

Your order will not be accepted until Ailand confirms its acceptance.

Before an order can be accepted, we must receive and process your payment. Please carefully review your order before submitting it, as we may not be able to accommodate cancellation requests after an order has been accepted.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided when you placed the order.

Purchased products are eligible for return or exchange only in accordance with our Returns and Refunds Policy.

You agree to use the products you purchase for personal or household purposes and not for commercial resale.

If customers outside Japan use an international forwarding service, we will ship the products to the designated address of the forwarding service provider in Japan.

After the forwarding service provider receives the products, the customer is responsible for and must bear all responsibility and costs related to delivery, forwarding fees, customs duties, import taxes, customs clearance procedures, and any other costs, issues, or problems.

We do not offer direct shipping to countries outside Japan.

Section 4 - Prices and Billing

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will be the price in effect at the time the order is placed and will be stated in the order confirmation email.

The product prices displayed on product pages include Japanese consumption tax. Shipping fees and other charges are governed by our Shipping Policy and the terms shown at checkout.

Domestic shipping is charged at a flat rate of ¥800, including tax. Shipping is free for orders totaling ¥11,000 or more, including tax. Additional shipping fees may apply to deliveries to Hokkaido, Okinawa, and remote islands.

If a customer outside Japan uses an international forwarding service, the customer is responsible for forwarding fees, customs duties, import taxes, customs clearance costs, and all other related costs.

Prices listed in our online store may differ from prices offered in physical stores, other online stores, or other stores operated by external services.

We may offer promotions from time to time relating to services that may affect pricing and that are subject to terms separate from these Terms of Service. If there is a conflict between the terms of a promotion and these Terms of Service, the terms of the promotion will prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our store.

You also agree to promptly update your email address, credit card number, expiration date, and any other account or payment information so that we can complete your transactions and contact you as necessary.

You represent and warrant that:

(i) the credit card information you provide is true, accurate, and complete;

(ii) you have the legal authority to use the credit card for the purchase;

(iii) the charges incurred by you will be approved by your credit card company; and

(iv) you will pay all charges incurred at the listed prices, including shipping fees, handling fees, and applicable taxes.

Section 5 - Shipping and Delivery

Shipping and delivery times are estimates and are not guaranteed.

Delivery may be delayed due to the delivery carrier, customs clearance procedures, or other events beyond our control.

If there is a problem with the delivery of your order, please contact us. We will respond in accordance with applicable law and our policies.

Section 6 - Intellectual Property

Our Services include, but are not limited to, all trademarks, brands, text, displays, images, graphics, product reviews, videos, audio, and the design, selection, and arrangement of these materials.

These materials are owned by Ailand, its affiliates, or its licensors and are protected by the Japanese Copyright Act, the Japanese Trademark Act, other intellectual property laws and regulations, and other applicable laws.

These Terms of Service permit you to use the Services solely for personal and non-commercial purposes.

Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services.

Except as expressly provided in these Terms of Service, nothing in these Terms grants or should be construed as granting any license or other rights under any patent, trademark, copyright, or other intellectual property of Ailand, Shopify, or any external service.

Unauthorized use of the Services may violate applicable intellectual property laws and regulations. All rights not expressly granted herein are reserved by Ailand.

The name Ailand, its logo, product names, service names, designs, and slogans are trademarks of Ailand, its affiliates, or its licensors. You may not use these trademarks without Ailand’s prior written permission.

The name Shopify, its logo, product names, service names, designs, and slogans are trademarks of Shopify.

All other names, logos, product names, service names, designs, and slogans on the Services are trademarks of their respective owners.

Section 7 - Optional Tools

We may provide access to tools made available by external services as part of the Services. We do not monitor, manage, or control these tools.

You acknowledge and agree that these tools are provided “as is” and “as available,” without warranties, representations, conditions, or recommendations of any kind.

We are not responsible for any liability arising out of or relating to your use of any external service tools.

Your use of any tools made available through the Services is entirely at your own risk and discretion. You should make sure that you are familiar with and agree to the terms and conditions established by the applicable external service provider.

We may provide new features through the Services in the future. These new features, including the release of new tools and resources, will also be considered part of the Services and will be subject to these Terms of Service.

Complaints, claims, concerns, or questions regarding products and services provided by external services should be directed to the applicable external service.

Section 9 - Our Relationship with Shopify

Ailand is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through the store are conducted directly by Ailand.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales relationship between you and Ailand, including any injury, damage, or loss arising from the products and services you purchase.

You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising out of or relating to your purchases and transactions with Ailand.

Section 10 - Privacy Policy

All Personal Information that we collect through the Services is subject to our Privacy Policy. Certain Personal Information may also be subject to Shopify’s Privacy Policy.

By using the Services, you acknowledge that you have read our Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes Personal Information about your access to and use of the Services in order to provide and improve the Services for you.

Information that you submit to the Services may be transmitted to and shared with Shopify and external service providers located in countries outside your country of residence for the purpose of providing the Services to you.

For example, we may use the rights granted under this license to operate, provide, evaluate, enhance, improve, and promote the Services, and to perform our obligations and exercise our rights under these Terms of Service.

You represent and warrant that:

(i) you own or otherwise possess all rights necessary to submit all of the Feedback;

(ii) you have disclosed any compensation or incentive that you received in connection with submitting the Feedback; and

(iii) your Feedback complies with these Terms of Service.

We are not obligated to:

(1) keep your Feedback confidential;

(2) pay you compensation for your Feedback; or

(3) respond to your Feedback.

We may, but are not obligated to, monitor, edit, or remove Feedback that we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, libelous, pornographic, obscene, otherwise objectionable, or in violation of the intellectual property rights of any party or these Terms of Service.

You agree that your Feedback will not infringe the rights of any external service or any other third party, including copyright, trademark, privacy, moral, or other intellectual property rights, or personal or proprietary rights.

You also agree that your Feedback will not contain defamatory, libelous, or otherwise unlawful, abusive, hateful, or obscene material, or any computer virus or other malware that could affect the operation of the Services or related websites.

You may not use a false email address, impersonate another person, or otherwise mislead us or any external service regarding the source of any Feedback.

You are solely responsible for any Feedback you submit and for its accuracy.

We assume no responsibility or liability for any Feedback posted by you or any external service.

(g) to send or request the sending of advertising or promotional materials, including “junk mail,” “chain letters,” “spam,” or any other similar solicitation;

(h) to impersonate or attempt to impersonate another individual or entity; or

(i) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that, as determined by us, may harm Ailand, Shopify, or users of the Services, or expose them to liability.

You also agree not to:

(a) upload or transmit viruses or any other type of malicious code that affects or may affect the functionality or operation of the Services;

(b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services;

(d) engage in spam, phishing, fraud, impersonation, or other similar activities;

(e) use robots, spiders, scraping tools, data-gathering or data-extraction tools, automated devices or processes, AI tools, including agentic AI, or any other automated or manual means to access the Services; or

(f) interfere with, circumvent, or evade the security or authentication features, robot exclusion headers, or any other measures adopted by us to restrict access to the Services.

We reserve the right to suspend, deactivate, or terminate your account at any time without notice if we determine that you have violated any part of these Terms of Service.

Section 14 - Agents

14.1 This section, the “Agent Terms,” applies if you use, authorize, enable, or deploy an Agent to access, use, or interact with the Services.

An “Agent” means software or a service that performs autonomous or semi-autonomous actions on behalf of or at the direction of an individual or entity. An Agent may act without direct supervision on behalf of an individual or entity or by using a device owned by that individual or entity.

14.2 An Agent may not access, use, or interact with the Services unless it clearly identifies itself and operates in strict accordance with the requirements of Section 14.4 below.

In addition, if we request that an Agent refrain from accessing, using, or interacting with the Services, the Agent may not access, use, or interact with the Services.

14.4 An Agent must:

(i) disclose the Agent’s name in every HTTP/HTTPS request by identifying that the request originates from an Agent and including the following user-agent string:

“Agent/[Agent Name]”

(ii) not conceal or obscure the fact that the access, use, or interaction originates from an Agent, including by:

(a) mimicking human behavior or interaction patterns; or

(b) completing or evading CAPTCHAs or other measures designed to distinguish between computers and humans;

(iii) respond truthfully to questions or prompts intended to determine whether an interaction originates from a human or a computer; and

(iv) not circumvent or evade any measures intended to block, limit, modify, or control whether or how an Agent accesses, uses, or interacts with the Services.

Section 15 - Termination

We may terminate this Agreement or your access to the Services, or any part of the Services, at any time without notice and in our sole discretion.

If we do so, you will remain responsible for all unpaid amounts due through the date of termination.

The following sections will continue to apply after termination:

Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

Section 16 - Disclaimer of Warranties

The information provided on or through the Services is provided for general informational purposes only.

We do not guarantee the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.

We disclaim all liability arising from your reliance on such materials, as well as the reliance of other visitors to the Services or any person informed of the contents of the Services.

Except as expressly stated by Ailand, the Services and all products offered through the Services are provided to you “as is” and “as available,” without representations, warranties, or conditions of any kind, whether express or implied.

This includes all implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, durability, title, and non-infringement.

We do not warrant, represent, or guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow limitations or exclusions of implied warranties or other warranties, so the above disclaimer may not apply to you.

Section 17 - Limitation of Liability

To the fullest extent permitted by law, in no event shall Ailand, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any of the following:

Any injury, loss, claim, or direct, indirect, incidental, punitive, special, or consequential damages arising from or relating to your use of the Services, your use of products obtained through the Services, or any content or products posted, transmitted, or otherwise made available through the Services.

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages.

We are not liable for such damages whether based on breach of contract, tort, including negligence, strict liability, or any other basis, and even if we have been advised of the possibility of such damages.

We are also not liable for errors or omissions in content available through the Services or for any other claim, loss, or damage in any way related to your use of the Services or products.

Section 18 - Indemnification

You agree to indemnify, defend, and hold harmless Ailand, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, and claims, including reasonable attorneys’ fees, arising out of or relating to:

(1) your violation of these Terms of Service or any document incorporated into these Terms of Service by reference;

(2) your violation of any law or the rights of a third party; or

(3) your access to or use of the Services.

We will notify you of any claim subject to indemnification. However, your obligations will not be excused if we fail to provide prompt notice, unless you suffer substantial disadvantage as a result.

We may control the defense and settlement of the claim at your expense, including the selection of attorneys. However, we will not settle any claim that requires you to undertake non-monetary obligations without your consent, which may not be unreasonably withheld.

You agree to cooperate in the defense of any claim subject to indemnification, including by providing relevant documents.

Section 19 - Severability

If any provision of these Terms of Service is determined to be unlawful, invalid, or unenforceable, that provision will nevertheless be enforced to the fullest extent permitted by applicable law.

The unenforceable portion will be deemed severed from these Terms of Service, but that determination will not affect the validity or enforceability of the remaining provisions of these Terms of Service.

The failure of us to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of that right or provision.

These Terms of Service, together with all policies and operating rules posted by us on this website or in connection with the Services, constitute the entire agreement and understanding between you and us and govern your use of the Services.

These Terms of Service supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us, including any prior versions of these Terms of Service.

Any ambiguity in the interpretation of these Terms of Service will not be construed against the drafting party.

Section 21 - Assignment

You may not delegate, transfer, or assign this Agreement or any of your rights or obligations under these Terms of Service without our prior written consent. Any attempted delegation, transfer, or assignment in violation of this provision will be void.

We may transfer, assign, or delegate these Terms of Service and our rights and obligations without your consent or notice.

Section 22 - Governing Law

These Terms of Service and any separate agreements under which we provide the Services to you shall be governed by and construed in accordance with the laws of Japan.

You and Ailand agree that the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.

The headings used in these Terms of Service are provided for convenience only and do not limit or otherwise affect the scope or interpretation of these Terms of Service.

You can review the most current version of these Terms of Service at any time on this page.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes on our website.

It is your responsibility to check our website periodically for changes.

We will notify you of material changes to these Terms of Service in accordance with applicable law. Such changes will take effect on the date specified in the notice.

Your continued use of or access to the Services after changes to these Terms of Service have been posted constitutes your acceptance of those changes.
